The new ACAS code of practice on Disciplinary and Grievance procedures came in to force on 11th March 2015. The new code was issued following uncertainty regarding workers’ statutory rights to be accompanied by a Trade Union Representative or fellow worker at Disciplinary or Grievance hearings.
The old code stated that employees could exercise their right to make a reasonable request to their employer to be represented. The new code states that employers must agree to a workers’ request to be represented by a companion, who can be either a fellow worker, a Trade Union Representative or an official employed by the Trade Union.
